TERMS OF SERVICE
1. Definitions

Outfront Health, we, us, our: Outfront Health, LLC, including its employees, officers, directors, agents, contractors, affiliates, and subsidiaries.

User, you, your: Any individual who accesses or uses our Site or Services.

Services: All offerings provided by Outfront Health, including but not limited to at-home blood test kits, coordination of in-home or event-based health screenings, access to digital dashboards, test result notifications, supplement and service recommendations, and educational content.

Labs: Independent third-party laboratories (e.g., CLIA-certified) that analyze collected blood or specimen samples.

Medical Providers: Independent clinicians or health professionals that may be engaged for oversight or services.

Personal Information / Health Data: Any data that can identify you, including test results, uploaded files, or biomarker information, as defined in our Privacy Policy.
2. Acceptance & Scope
By creating an account, purchasing a product, or using any Services, you agree to these Terms. These Terms apply to U.S. residents and govern your access to and use of the Site. If you are outside the U.S., you are solely responsible for compliance with local laws. Accessing the Site from a jurisdiction where Services are restricted is done at your own risk.
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter.
Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page, so you are aware of any changes, as they are binding on you and your use of the Site and the Services.
3. Eligibility & Age Requirements

You confirm you are legally competent to consent to collection and testing of your sample.
We do not knowingly collect data from minors. If we become aware of a minor user, their data may be deleted, and Services may be terminated.
4. Nature of Our Services
4.1 Self-Collected Testing
You are responsible for properly collecting and shipping your sample according to kit instructions. Shipping delays, errors, or damages may affect test quality.
4.2 Third-Party Labs
We coordinate with independent CLIA-certified labs that conduct testing. Outfront Health is not a lab. Outfront Health is not responsible for lab performance, analysis errors, or lost samples.
4.3 Result Delivery
You will be notified when your test results are ready. Only licensed healthcare providers can offer interpretation or diagnosis based on these results. Results are for informational purposes only and do not replace consultation with your physician.
4.4 State Restrictions
Certain states restrict direct-to-consumer laboratory testing. Some tests may require additional physician oversight or local licensure. We reserve the right to cancel and refund orders if local laws or regulatory changes prevent delivery. Please see lab certifications here.
4.5 In-Home and Event-Based Health Screenings
Services may include ultrasound imaging, body composition analysis, grip strength, balance assessments, AFib screening, and ABI testing.
Screenings are conducted by licensed professionals, certified technicians, or trained personnel.
Screenings are intended to promote awareness and early health discussions but do not constitute diagnosis or treatment. Consult a licensed provider for follow-up.
You are responsible for providing a safe environment. Outfront Health is not liable for delays, cancellations, or adverse events caused by third-party personnel or conditions.
4.6 In-Person Clinic Services
Outfront Health may operate or partner with brick-and-mortar clinic locations where certain services are offered on-site, including specimen collection, rapid testing, point-of-care diagnostics, physical examinations, and other clinical procedures as posted at the applicable location.
4.6.1 Appointments and Walk-Ins
Services may be available by appointment, on a walk-in basis, or both, depending on the clinic location and applicable service line. Appointment scheduling is available through our website, mobile application, or by contacting the clinic directly. Walk-in availability is subject to capacity, staffing, and the nature of the requested service. Outfront Health does not guarantee that walk-in patients will be seen on the same day and reserves the right to require an appointment for certain services or procedures.
4.6.2 On-Site Procedures
Certain clinic locations may offer on-site clinical procedures, including but not limited to blood draws, specimen collection, rapid diagnostic testing, vaccinations, and point-of-care screenings. All on-site procedures are performed by licensed healthcare providers, certified technicians, or trained clinical staff operating within their respective scope of practice and in accordance with applicable state and federal law.
4.6.3 Informed Consent
You may be required to sign a separate informed consent form prior to receiving certain in-person services or procedures. By presenting for an in-person visit, you acknowledge and agree that you have been given the opportunity to ask questions and that you voluntarily consent to the services rendered.
4.6.4 Clinic Policies and Conduct
While on clinic premises, you agree to comply with all posted policies, including those related to identification verification, payment, insurance, cancellation and no-show fees, mask and hygiene requirements, and visitor conduct. Outfront Health reserves the right to refuse service or require a patient to leave the premises for failure to comply with clinic policies, abusive or threatening behavior toward staff or other patients, or any conduct that, in the reasonable judgment of clinic personnel, compromises patient or staff safety.
4.6.5 Limitations of In-Person Services
In-person clinic services are intended to supplement, not replace, an ongoing relationship with your primary care provider. Results and findings from in-person visits are for informational and screening purposes only unless otherwise communicated in writing by a licensed provider. Outfront Health is not responsible for delays, interruptions, or cancellations of in-person services caused by staffing shortages, equipment malfunctions, public health emergencies, or other circumstances beyond our reasonable control.
4.6.6 Records and Privacy
Health information collected during in-person visits is maintained in accordance with our Privacy Policy, our Notice of Privacy Practices, and applicable federal and state privacy laws, including HIPAA where applicable. You may request access to your records as described in our Privacy Policy.
5. No Medical Advice or Doctor-Patient Relationship
Use of Services does not create a doctor-patient relationship. Outfront Health is a platform that helps facilitate access to lab testing and screening kits; Outfront Health is not a health care provider and we do not provide medical care or advice. Always consult a licensed provider for interpretation of testing or treatment.
6. Account Registration & Responsibilities
To access the Site or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Site that all the information you provide on the is correct, current, and complete. You agree that all information you provide to register with this Site or otherwise, including, but not limited to, through the use of any interactive features on the Site, is governed by our Privacy Policy, linked above, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.
If you choose, or are provided with, a username, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Site or portions of it using your username, password, or other security information. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.
We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time, if, in our opinion, you have violated any provision of these Terms.
We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict user access, including registered user access, to some parts of the Site or the entire Site.
You are responsible for:

7. User Obligations & Prohibited Activities

For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
To impersonate or attempt to impersonate the Outfront Health, an Outfront Health employee, another user, or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing).
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Outfront Health or users of the Site, or expose them to liability.
Additionally, you agree not to:

Use the Site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Site, including their ability to engage in real time activities through the Site.

8. Pricing, Payments & Refunds

All prices are in U.S. dollars. You are responsible for taxes and shipping fees.

By submitting a payment method, you authorize us (or our processor) to charge it.

Refunds generally not available once a kit is shipped, used, or a physical screening is scheduled. See Refund Policy for details.

We reserve the right to adjust prices at any time.
9. Emotional Readiness
9.1 General Acknowledgment
You acknowledge that lab results, screening outcomes, and health-related findings—whether delivered electronically, by mail, or communicated in person—may cause emotional distress, anxiety, fear, or other adverse psychological responses. By using any Outfront Health service, you accept this risk and agree that you are emotionally prepared to receive health information that may be unexpected, unfavorable, or require further evaluation. If you have concerns about your ability to receive such information, consult a medical or mental health professional before using our services.
9.2 In-Person and On-Site Screening Context
Certain in-person services—including but not limited to ultrasound imaging, point-of-care diagnostics, rapid testing, and real-time body composition analysis—may involve immediate or near-immediate feedback during the visit. You acknowledge that receiving preliminary observations, visual images of your body or anatomy, or real-time screening data may provoke anxiety, emotional distress, or concern, particularly where findings are unexpected or require follow-up evaluation. By presenting for an in-person visit or on-site screening, you voluntarily accept this risk.
9.3 On-Site Support and Escalation
Outfront Health personnel are trained to respond to patient distress during in-person visits in a compassionate and professional manner. However, on-site staff are not licensed mental health providers unless expressly identified as such, and any emotional support provided during a visit is offered as a courtesy and does not constitute mental health counseling, therapy, or crisis intervention. If you experience significant emotional distress during or after an in-person visit, Outfront Health encourages you to contact your primary care provider, a licensed mental health professional, or, in the event of a crisis, the 988 Suicide and Crisis Lifeline (call or text 988) or your local emergency services.
9.4 Limitation of Liability for Emotional Responses
To the fullest extent permitted by applicable law, Outfront Health, its officers, directors, employees, contractors, and affiliated providers shall not be liable for any emotional distress, psychological harm, anxiety, or related damages arising from or connected to the receipt of lab results, screening outcomes, in-person observations, preliminary findings, imaging feedback, or any other health-related information provided through our services—whether delivered remotely or on-site. This limitation applies regardless of whether the information is later confirmed, modified, or superseded by a licensed provider’s diagnosis or interpretation.
10. Privacy & Data Security

Use of Services is governed by our Privacy Policy and our Consumer Health Data Privacy Policy, each of which is incorporated herein by reference. Our Consumer Health Data Privacy Policy, available at [insert direct URL], describes the categories of consumer health data we collect, the purposes for collection and use, the categories of third parties with whom such data is shared, and the rights available to you under the Washington My Health My Data Act (Chapter 19.373 RCW) and similar state consumer health data privacy laws. By creating an account, purchasing a testing kit, scheduling a clinic visit or screening, or otherwise providing consumer health data to Outfront Health, you acknowledge that you have been provided access to, and have had the opportunity to review, our Consumer Health Data Privacy Policy. Where required by applicable law, your separate affirmative consent to the collection and sharing of consumer health data will be obtained prior to such collection or sharing and will not be deemed granted by your acceptance of these Terms of Service alone.Partner labs and providers are subject to HIPAA where applicable.

We implement industry-standard safeguards but cannot guarantee absolute security. Users must also protect their accounts.

Health data may be stored, analyzed, and shared with third-party labs, clinicians, and service providers as necessary.
11. Intellectual Property Rights and Trademarks
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Outfront Health, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

You may store files that are automatically cached by your Web browser for display enhancement purposes.

All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners
12. Disclaimers & Warranties
You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Site will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. 13. Evolving Medical Science
Biomarker interpretation may change as science evolves. Outfront Health is not responsible for future reclassifications of test results.
14. Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF OUTFRONT HEALTH AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID TO OUTFRONT HEALTH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT FOR THE APPLICABLE CONTENT, PRODUCT, OR SERVICE OUT OF WHICH LIABILITY AROSE.
The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, governmental actions, labor disputes, internet or telecommunication failures, or other events of force majeure.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Outfront Health, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your user contributions, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

18. Dispute Resolution & Arbitration
Governing Law and Jurisdiction
All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the State of Arizona or any other jurisdiction).
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Arizona, in each case located in the City of Phoenix and County of Maricopa County, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of the Site or Services, including disputes concerning the interpretation, violation, invalidity, non-performance, or termination of these Terms (collectively, "Disputes"), shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, except as otherwise provided herein. Either party — you or Outfront Health — may elect to initiate arbitration by delivering written notice to the other party describing the nature of the claim and the relief sought. The arbitration shall be conducted by a single arbitrator, shall be governed by the laws of the State of Arizona (without regard to conflict-of-laws principles), and shall take place in Maricopa County, Arizona, unless the parties mutually agree otherwise or the arbitrator determines that an alternative location or virtual proceeding is warranted for good cause. Each party shall bear its own attorneys' fees and costs, and the parties shall share equally the arbitration filing fees and arbitrator compensation, except where applicable law or AAA rules require otherwise. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You and Outfront Health each agree that any Dispute will be resolved only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or data security obligations.
19. Electronic Communications
By using Services, you consent to receiving notices, results, and updates electronically.
20. Compliance & Export Controls
You agree to comply with all U.S. laws and export controls. Services may not be used in restricted countries or for prohibited purposes.
21. Waiver; Severability
No waiver by Outfront Health of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Outfront Health to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
22. Entire Agreement
These Terms, Privacy Policy, Consumer Health Data Privacy Policy, Refund Policy, and related policies constitute the sole and entire agreement between you and Outfront Health regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the website.
23. Changes to Terms and Reliance on Information Posted
Outfront Health or We may update the content on this Site from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.
The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site, or by anyone who may be informed of any of its contents.
This Site may include content provided by third parties, including materials provided by other users, vendors, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by Outfront Health, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of Outfront Health. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.
24. Referral Program
Eligibility: You must have an active Outfront Health account in good standing to participate in the referral program. Outfront Health reserves the right to determine eligibility and to disqualify any participant who violates these Terms or engages in fraudulent, misleading, or abusive referral activity.
Code Use: Referral codes are intended for personal sharing with individuals within your personal network. Referral codes may not be posted on coupon aggregator sites, deal forums, or paid advertising channels unless expressly authorized by Outfront Health in writing. You are required to clearly and conspicuously disclose your material connection to Outfront Health — including that you will receive compensation, credit, discount, or other benefit if the referred individual makes a purchase — any time you share a referral code or link. This disclosure obligation applies to all media and platforms, including but not limited to social media posts, blog content, text messages, emails, and verbal communications, and arises under the Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255) and the FTC's enforcement guidance on material connections.
Your disclosure must be: (i) in clear and unambiguous language; (ii) placed where it is difficult to miss — not buried below the fold, behind a "see more" link, or in a string of hashtags; and (iii) made in each instance you share a referral code, even if you have previously disclosed the relationship in another post or context. Examples of compliant disclosures include:

Disclosures using only ambiguous terms such as "#ambassador," "#collab," or "#partner" without further explanation do not satisfy this requirement. You are solely responsible for ensuring your referral activity complies with all applicable FTC guidelines and state consumer protection laws. Outfront Health reserves the right to revoke referral privileges, withhold or claw back referral rewards, and terminate your account if you fail to make required disclosures or otherwise engage in deceptive or non-compliant referral practices.

Right to Modify: Outfront Health may modify, suspend, or terminate the referral program, including reward amounts, eligibility criteria, and program terms, at any time and in its sole discretion, with or without notice. Any accrued but unredeemed referral rewards at the time of termination are subject to forfeiture unless otherwise required by applicable law.
